Rape Charge
Certified
Felony charges of rape and object sexual penetration against a former Washington and Lee University student have been certified to a grand jury.
Ricardo Vergara, 20, of Nashville, Tenn., is facing two felony charges and one misdemeanor charge of sexual battery in connection with an incident involving another student on Jan. 14. Following an investigation by the Lexington Police Department, Vergara was arrested on Feb. 26 and was expelled from the university.
A preliminary hearing on the charges was scheduled in Rockbridge County General District Court for Sept. 11, but Vergara waived the hearing as part of an agreement to keep a plea offer from the commonwealth attorney’s office on the table. Both the prosecution and the defense stipulated that there was enough evidence to certify the charges to the grand jury and Judge Christopher Billias certified the charges.
The next Rockbridge County grand jury meets on Nov. 6, at which point it will hear evidence against Vergara and determine if there is enough evidence to warrant an indictment. Following the indictment, Vergara will either stand trial or accept a plea and be sentenced.
In the interim, Vergara has been instructed to continue abiding by the conditions of his bond, which include a prohibition on entering the property of any college campus, not having any contact with the victim, and to return to Tennessee, only coming back to Rockbridge County for court appearances.
