Second Man Sentenced In BV B&E

Gregory Kersey, the second of three individuals charged in connection with a breaking and entering case in January of 2023 that resulted in a shelter-in-place order being issued for the city of Buena Vista, was sentenced in Buena Vista Circuit Court on June 7.

Kersey had been indicted by a grand jury on two felony counts of armed burglary in January, and entered pleas to two counts of entering a home with intent to commit assault and battery.

He was sentenced to 10 years for one count and five years for the second, with all but 11 months of each sentence suspended. The sentences will be served concurrently. Kersey also entered a guilty plea to a misdemeanor count of assault and battery, for which he received a sentence of 12 months. If Kersey successfully completes the Community Corrections Alternative Program, that sentence will be suspended.

A fourth charge against Kersey, a misdemeanor count of obstruction of justice, was dismissed.

Another individual charged in connection with the January 2023 incident, Dakota Camden, entered a guilty plea on Sept. 25, 2023, to two felony counts, one count of burglary and one count of conspiracy to commit burglary, as well as a misdemeanor count of assault and battery. He was sentenced on April 1 to 10 years for the burglary charge and five years for the conspiracy charge, with all but 10 months of each sentence suspended. He also received a 12month sentence for the assault and battery charge, which will be suspended upon successful completion of the CCAP program.

The third individual, Tytray Martin of Highland Springs, was indicted on the same charges as Camden and pled not guilty. He was scheduled to stand trial on the charges on Jan. 24, but failed to appear in court for a pretrial hearing on Jan. 5, resulting in a warrant being issued for his arrest. Martin was taken into custody on June 13 and a hearing to set a date for a trial on the original charges as well as two misdemeanor counts of failure to appear in court and one misdemeanor count of violation of the conditions of release is scheduled for June 21.
