Pursuant to Code of Virginia Section 15.2-2204 , Section 15.21800, and the City of Buena Vista Land Development Regulations, notice is given that the Planning Commission will hold a public hearing to receive comment on the following matters.

1. Zoning Map Amendment, Conditional Use Permit, and Right of Way Abandonment, Tax Maps 47-1-1-27-1, 47-1-E—-A, 47-11-27-6 through 10; 600 block of Magnolia Avenue. The project proposes to rezone from R3 Residential Limited to R4 Medium Density Residential for the purpose of constructing 22 townhouses and associated private driveways and parking. The undeveloped alley running through this block would be abandoned.

The Public Hearing will be held in the City Council Chambers located in the Municipal Building located at 2039 Sycamore Avenue in Buena Vista during the regular monthly Planning Commission meeting at approximately 7:00 PM on Tuesday, March 11th 2025. CITY OF LEXINGTON NOTICE OF CANCELLED PUBLIC HEARING APPLICATION FOR A CONDITIONAL USE PERMIT TO ALLOW 120 S. MAIN STREET TO BE USED AS A DAY CARE CENTER

The public hearing to review a Conditional Use Permit application submitted by Misty Camden to allow a portion of Lexington Presbyterian Church located at 120 S. CITY OF LEXINGTON NOTICE OF PUBLIC HEARING TO REVIEW AN APPLICATION FOR A CONDITIONAL USE PERMIT TO ALLOW 120 S.

MAIN STREET TO BE USED AS A DAY CARE CENTER A public hearing will be conducted by Lexington City Council at 7:00 P.M. on Thursday, March 6, 2025 in the first floor meeting room of the Rockbridge County Administrative Offices, 150 South Main Street, to allow persons to appear and present their views in response to a Conditional Use Permit application submitted by Misty Camden. The application is a request for a Conditional Use Permit that would allow a portion of Lexington Presbyterian Church located at 120 S. Main Street (Tax Map # 23-1-180) to be used as a day care center.

A copy of the application, case number CUP 2025-02 is available for public review and examination between 8:00 A.M. and 5:00 P.M. in the Planning and Development Department located on the second floor of Lexington City Hall, 300 East Washington Street.

The public hearing to review a proposal to amend Article III. Use Matrix, Article XI. Use and Design Standards, and Article XX. Definitions of the Lexington Zoning Ordinance to allow cottage housing developments in Lexington’s residential zoning districts, which was advertised for a Lexington City Council public hearing to begin at 7:00 p.m. on Thursday, March 6, 2025, has been cancelled.

ROCKBRIDGE COUNTY NOTICE OF PUBLIC HEARINGS

Notice is hereby given per Section 15.2-2204 of the Code of Virginia and Section 808 of the County of Rockbridge Land Development Regulations (the Regulations) that public hearings will be held by the Rockbridge County Planning Commission on Wednesday, March 12, 2025, at or after 7:00 p.m. in the Board of Supervisors Meeting Room in the County Administration Building, 150 South Main Street, Lexington, Virginia 24450 to consider the following applications: 1. Nicholas and Bethany Iocco, 1372 Raphine Road, Raphine, Virginia 24472 have made an application to amend a condition associated with a previously approved special exception permit (SEP) for a commercial kennel (dog breeding) in the Agricultural and General Uses (A-2) Zoning District. The property is identified as 1492 Raphine Road, Raphine, Virginia 24472 and further identified as TM# 27-A-23B (1.88 ac. per tax records). The property is on the southside of Raphine Road (Route 606), approximately 0.39 miles west of the intersection of Raphine Road (Route 606) and Ridge Road (Route 613). The property is owned by Nicholas and Bethany Iocco. The SEP to develop a commercial kennel was approved, with conditions, by the Board of Supervisors on May 23, 2022. The pending application is to amend condition number two, requesting an amendment to the dog breeds associated with the breeding business. The property is in the Walkers Creek Magisterial District.

2. USS Hilltop Solar LLC,323 Washington Avenue, Suite 350, Minneapolis, Minnesota has made an application to amend a condition with a previously approved special exception permit (SEP) for a public utility (solar facility). The property is identified as 331 Lloyd Tolley Road, Natural Bridge Station, Virginia 24579 and further identified as TM# 113-5-D (157.76 ac. per tax records). The property is located on the southwest side of the intersection of Lloyd Tolley Road (Route 773) and Gilmores Mill Road (Route 708). The property is owned by William S. Shepherd and Jennifer K. Rattigan, 30 Appaloosa Lane, Natural Bridge Station, Virginia 24579. The SEP to develop a public utility in the Agricultural and General Uses (A-2) Zoning District and the Agricultural Transitional (A-T) Zoning District was approved, with conditions, by the Board of Supervisors on January 8, 2024. The pending application is to amend condition number nine, requesting an extension to the implementation and completion dates. The property is located in the Natural Bridge Magisterial District.

3. BARC Electric Cooperative, PO Box 246 Millboro, Virginia, 24460 has made an application to amend a condition associated with a previously approved special exception permit (SEP) for a public utility (office complex, equipment yard, and solar facility) in the Agricultural and General Uses (A-2) Zoning District. The property is identified as 1972 Big Spring Drive, Lexington, Virginia 24450 and is further identified as TM# 47-A-50(15.24 ac. per tax records). The property is located on the northeast side of the intersection of W. Midland Trail (Route 60) and Fredericksburg Road (Route 60). The property is owned by BARC Electric Cooperative (above address). The SEP to develop a public utility was approved, with conditions, by the Board of Supervisors on May 26, 2015; an amended SEP was approved by the Board of Supervisors on March 28, 2016. The pending application is to amend conditions associated with the March 28, 2016 SEP, requesting the area that was approved as a portion of the solar facility, be utilized for an equipment/laydown yard and warehouse. This area is currently utilized as an equipment/ laydown yard, operating under four previously approved two-year SEP’s. The current temporary SEP expires on April 24, 2025. The property is in the Kerrs Creek Magisterial District.

4. County of Rockbridge, Virginia, 150 South Main Street, Lexington, Virginia 24450, Zoning Text Amendment (ZTA) to modify Section 605 (General Business District B-1), Section 605.03 (Special Exceptions)of the Regulations to provide for the use of a private school as a use by special exception in the B-1 Zoning District. CITY OF LEXINGTON NOTICE OF PUBLIC HEARING TO REVIEW A PROPOSED AMENDMENT TO THE CITY OF LEXINGTON ZONING ORDINANCE

A public hearing will be conducted by Lexington City Council at 7:00 P.M. on Thursday, March 6, 2025 in the first floor meeting room of the Rockbridge County Administrative Offices, 150 South Main Street, to allow persons to appear and present their views in response to a proposal to amend the Zoning Ordinance to allow cottage housing developments in Lexington’s residential zoning districts. The proposal is to amend Article III to add Cottage Housing Development as a conditional use in the R-1, R-2, R-M, and R-LC zoning districts; to amend Article XI to add use and design standards for cottage housing developments; and to amend Article XX to add a definition for cottage housing development.

A copy of the draft Zoning Ordinance Amendment, case number ZOA 2025-01, is available for public review and examination between 8:00 a.m. and 5:00 p.m. in the Planning and Development Department located on the second floor of Lexington City Hall, 300 East Washington Street.
